Contractor - Terms and Condtions
Appointment to Approved Contractor status is subject to the following conditions being accepted and adhered to:
- Acceptance of these conditions is implied by the execution of the work.
- Except in an emergency, instructions will be in writing and on an official Works Order. Only personnel employed by R3 Repairs can instruct work, tenants and occupiers cannot issue instructions.
- Timescales:
Emergency Repairs
Urgent Repairs All work must be completed to the timescales agreed at the time of instruction given.
All Routine Repairs
- The work must be carried out in a clean tradesman like manner with the site kept as clean as possible at all times. Rubbish arising from the works is to be removed during the work and at completion to leave the job site “as found.” All rubbish must be disposed of in an acceptable manner.
- The contractor must provide his own plant, scaffolding, tools, etc., as required to carry out the work and arrange for any temporary lighting, safety barriers etc. required. The contractor must make his own arrangements for the use of electrical power to occupied houses. In the case of vacant properties, the contractor may use electric power at no cost but must make his own connections. The use of water will not be unreasonably withheld.
- The contractor must have adequate insurance cover, so as to relieve R3 Repairs of all liabilities arising out of the carrying out of works, whether loss or damage to persons or property, the cover for any one event being £10 Million
- The company’s properties are held insured against fire, storm, flood, etc., by the company but the contractor will be held responsible for negligence and the like by himself or his employees. He will also be responsible for the safety of all plant, tools and materials brought on site for the work, and must make good any loss or damage of same from fire, vandalism, theft, etc.
- The contractor must not, as a result of work, leave the property other than lock fast overnight.
- Notice of job completion must be submitted verbally immediately and in written form within 24 hours of the work being completed. Any works issued must be completed within the allocated time scale (i.e. target date). If it is not, compensation is paid to the tenant. Compensation will be calculated by R3 Repairs and deducted from any invoice received from the contractor.
- Invoices shall be rendered within 21 days of satisfactory completion of the work. No interim payments will be made, and no retention held. Payment will follow invoice submission within 28 days, unless disputed. The work will be subject to a 12-month defects liability period.
- Submitted invoices to include date on which work was carried out, along with the official job number.
- Any dispute or difference shall be referred to a mutually agreed arbiter, or after 14 days non-agreement to an arbiter appointed by the President of the Chartered Institute of Arbiters. The Law of Scotland shall apply to any arbitration. The arbiter’s decision will be final and he shall have the power to award expenses
